ITR 2 is applicable to NRIs except for those having income from Business or Profession in India. NRIs having business or professional income in India must file ITR 3. ITR 1 is no longer available for NRIs.
The due date of filing ITR for FY 2023-24, i.e. AY 2024-25, is 31st July 2024. However, if you miss the due date, you can still file belated ITR by 31st December 2024 after paying late fees which may extend upto ₹5,000/-.
AIS is the extension of Form 26AS. Form 26AS displays details of property purchases, high-value investments, and TDS/TCS transactions carried out during the financial year. AIS additionally includes savings account interest, dividend, rent received, purchase and sale transactions of securities/immovable properties, foreign remittances, interest on deposits, GST turnover etc.
AIS also provides the taxpayer the option to give feedback on the transactions reported. Further, the aggregation of transactions on information source level is also reported in TIS.
It is not mandatory to file ITR if your income is below ₹250,000/-. However, considering TDS deduction on Interest on NRO account at the rate of 31.2%, it makes sense to file the income tax return and claim the refund of TDS deducted.
In case of NRI, only income earned in India is taxable in India. Income earned by NRI in his country of residence or any other country apart from India is not taxable in India. Also, NRI is not required to disclose his foreign income or foreign assets while filing Income Tax Return.
